NATIONWIDE MUSIC DISTRIBUTION AND PROMOTION SERVICE   

::: Rules and Guidelines

To enroll in American Music Distribution, you must have worldwide distribution rights to the title you want to enroll.

If your title is a music CD, it must have a UPC that is bar-coded and readable on the package. Music CDs must also be shrink-wrapped in a protective case, such as a plastic jewel case, with the title and artist name printed on and readable from the spine (the thin side of the CD). Each title must also satisfy American Music Distributions suitable standards. These standards currently relate to quality, value, subject matter, production standards, and compliance with intellectual property laws. In no event will any title that we deem, at our sole discretion, to be pornographic or not of our distribution suitable standards be accepted into the program.

Shipping Instructions:

Our initial order will be for a conservative number of copies (usually between 50 to 100.) If your sales increase, we may order larger quantities in subsequent orders. Ship the requested number of copies of your title to the designated distribution center. (Send P&D Agreement and requested number of copies of your CD to: American Music Distribution P.O. Box 15592 Del City , OK 73101 ) Please do not send more copies than we request. All copies must be shipped “FOB destination” (meaning that you, the vendor, bears the liability and expense of transportation until the package is received in good order at our facility). Cost includes packaging, insurance, customs clearance and duties (where applicable), and freight. All items shipped must also have a scannable bar code printed on the item.

*Note: All artist or record labels must supply either by email or provided with merchandise and P&D agreement being returned, images of artist CD cover in (JPEG or GIF Format) and a item description for each product being listed in our program.

Once your signed P&D agreement and merchandise is successfully received, we will send you confirmation by e-mail. If you don’t receive this e-mail, we did not receive your signed P&D Agreement or merchandise, and we ask that you try again.

American Music Distribution will not issue compensation for packages or items lost in transit to our fulfillment center. Compensation for lost packages or items can only be issued if Proof of Delivery is available to indicate the item was in fact delivered to our fulfillment center. Proof of delivery to our fulfillment center must include all of the following information: (1) shipper’s tracking ID number, (2) date and time of delivery, (3) location of delivery, (4) weight of the package upon shipment, (5) name of receiver. Compensation for partially received shipments requires proof of the item’s weight at the time of arrival at our fulfillment center. We strongly recommend choosing a shipping method that is traceable and/or insuring your parcel with your shipper.

Replenish your inventory.

When inventory of your title gets low, American Music Distribution will send you an e-mail requesting more copies. Please check that the ISBN or UPC on the items you are shipping matches the ISBN or UPC listed in the order, and that the scannable bar code still matches the ISBN or UPC on your title. If a new edition is available for your title, the new edition cannot be substituted for the previous edition. If for any reason you cannot fill this or future orders for an ISBN or UPC, you must send us an e-mail immediately. Failure to notify us of a change in status (i.e., out of stock or out of print temporarily or permanently) may result in suspension of your American Music Distribution account.

Our distribution department anticipates customer demand and will order an optimal quantity. This ensures that copies of your title are almost always on hand and available to ship “within 24 hours.” The number of copies we reorder will depend in part on how well your title has recently sold. If it has sold well, we may order in larger quantities. If sales of your title have dropped off recently, we may subsequently order fewer copies.

If we run out of stock on your title, the availability listing will revert to an availability based upon your past delivery performance for shipments to American Music Distribution.

If we find that there is violations of the American Music distribution P&D Agreement, we may choose to no longer hold copies in inventory. In such a case, we’ll return all copies to you. (There will be no refund!) You will pay all charges (including packaging, insurance, and freight) incurred to ship copies from the American Music Distribution center to your location. Items that cannot be returned because of incorrect or outdated address information will be liquidated or destroyed. Although the title will no longer be part of the American Music Distribution program.

Receive payments for copies sold.

American Music Distribution will automatically issue you a check for copies sold during a given month at the end of the following month. For instance, if a copy sells any time during the month of January, American Music Distribution will issue and mail you a check by the last day of February. This allows us to account for any returns we may have on your title.

All payments will be made in U.S. dollars.

For music CDs, we will pay you 70% of the suggested retail price you selected.

 Communication via e-mail

All communications between you and American Music Distribution relating to American Music Distribution must be sent via e-mail to the following e-mail address: info@AmericanMusicDistribution.com. We will send all notices and other communication to you at the e-mail address you listed in your program agreement or, where applicable.

Applicability of program Instructions and Rules The program Instructions and Rules described above and in your Promotions and Distribution Agreement may change from time to time. All American Music Distribution activities will be governed by the program Instructions and Rules in effect at the time they occur.
